The group took note of the comments, questions and reservations of various delegations regarding the compact proposal, indicating the need for further clarification on a number of aspects of that proposal, including with regard to: the independent expert's conceptual approach to the right to development; the nature of obligations and responsibilities at the national and international levels; the notion of “mutuality of obligations” and its implications for the legal accountability of States and for domestic ownership of development; the question of the fulfilment by States of their human rights obligations and its relationship to conditionality; the operational feasibility of the compact model; the risk of duplication and the relative advantage of the compact over integration of the right to development into existing mechanisms and instruments; the need to pay explicit attention to women, indigenous populations and minorities; the proposal's resource implications; the role of domestic resource mobilization in the compact model; the composition of the proposed compact support group and the role of civil society in that body and in the compact in general; corresponding redress mechanisms; the need for appropriate indicators to accompany the model; and the ways to advance the right to development while the compact model is being further clarified.
