Extensive jurisprudence of international criminal tribunals makes clear that the doctrine of superior responsibility reflected in principle 27 (b) should be understood to apply, when relevant, in respect of individuals exercising de facto control over subordinates as well as to individuals whose power to control subordinates derives from de jure authority.

In accordance with the principle of superior responsibility, which forms part of customary international law, I urge State and non-State parties to armed conflicts to ensure that civilian superiors and military commanders use their authority and powers to prevent sexual violence and punish crimes committed by subordinates, failing which they themselves must be punished.
ووفقا لمبدأ مسؤولية الرؤساء، الذي يشكل جزءا من القانون الدولي العرفي، أحث الأطراف في النزاعات المسلحة من الدول ومن غير الدول على ضمان استخدام الرؤساء المدنيين والقادة العسكريين سلطاتهم وصلاحياتهم لمنع العنف الجنسي والمعاقبة على الجرائم التي يقترفها مرؤوسوهم، وأن يعاقبوا هم أنفسهم إذا لم يقوموا بذلك.

In convicting both the commander and the deputy commander of the Celebići detention camp, the Trial Chamber stated: “Thus, a superior may be held criminally responsible not only for ordering, instigating or planning criminal acts carried out by his subordinates, but also for failing to take measures to prevent or repress the unlawful conduct of his subordinates.” The Trial Chamber further noted that “the applicability of the principle of superior responsibility extends not only to military commanders but also to individuals in non-military positions of superior authority.”
