وفي ضوء الاعتبارات السابقة، خلص المجلس الانتخابي الوطني الحالي، منطلقا من تفسيره الصحيح لدستور جمهورية فنزويلا البوليفارية، إلى أن مبدأ المساواة وعدم التمييز ليس مكرّسا في الأحكام العامة للدستور فحسب، وفي أحكام الفصلين المتعلقين بالجنسية والمواطنة، والفصل المتعلق بالحقوق السياسية، بل إن مبدأ المساواة بين المواطنين والمواطنات هو موضوع يتخلل كامل الدستور، بدءا من ديباجته، ويؤكده أيضا استخدامه للغة غير متحيزة جنسانيا.
