If the insolvency law provides that a contract clause which, upon the commencement of insolvency proceedings or the occurrence of another insolvency-related event, automatically terminates any obligation under a contract or accelerates the maturity of any obligation under a contract, is unenforceable as against the insolvency representative or the debtor, then the insolvency law should specify that such provision does not render unenforceable or invalidate a contract clause relieving a creditor from an obligation to make a loan or otherwise extend credit or other financial accommodations to or for the benefit of the debtor.
زاي- إذا كان قانون الإعسار ينص على أن الشرط الوارد في العقد والذي يقضي بالإنهاء الآلي لأي التزام بمقتضى العقد أو بتعجيل استحقاق أي التزام بمقتضى العقد عند بدء إجراءات الإعسار أو عند وقوع حدث آخر متصل بالإعسار هو شرط غير قابل للسريان على ممثل الإعسار ولا على المدين، فإن قانون الإعسار ينبغي أن ينص على أن هذا الحُكم لا يحول دون سريان الشرط الوارد في العقد والذي يعفي الدائن من التزام تقديم قرض أو تمديد الائتمان أو غير ذلك من التسهيلات المالية للمدين أو لصالحه، ولا يلغي ذلك الالتزام.

إذا كان قانون الإعسار ينص على أن الشرط الوارد في العقد والذي يقضي بالإنهاء التلقائي لأي التزام بمقتضى العقد أو بتعجيل استحقاق أي التزام بمقتضى العقد عند بدء إجراءات الإعسار أو عند وقوع حدث آخر متصل بالإعسار هو شرط غير قابل للإنفاذ على ممثل الإعسار أو على المدين، فينبغي أن ينص قانون الإعسار أيضا على أن هذا الحُكم لا يحول دون إنفاذ الشرط الوارد في العقد والذي يعفي الدائن من التزام تقديم قرض أو تقديم ائتمان أو غير ذلك من التسهيلات المالية لصالح لمدين، أو يلغي ذلك الشرط.
