This applies in particular to the banking sector in which the conditions under which bank branches are authorized to operate and the particular constraints that they face concerning both their mode of refinancing and their prudential rules, require their being placed under a regime linked to the law of their location.
وينطبق ذلك بوجه خاص على القطاع المصرفي حيث ان الظروف التي يرخص فيها لفروع المصرف بممارسة أنشطتها، والتقييدات الخاصة التي تواجهها سواء فيما يتعلق بالطريقة التي تتبعها لاعادة التمويل أو فيما يتصل بقواعدها الخاصة بالحيطة، تقتضي أن تكون خاضعة لنظام يرتبط بقانون البلد الذي توجد فيه.
